## **Title I - Rights and duties**

#### **Article 1**.

Oniverse is a support and a structure proposing the linking, integration and institutionalization of a set of cyber-physical systems, in a realistic, structured, open, equitable and ethical dynamic.

Its operation is based on:

* the integration of all the activities that originate from it, that take place in it or that are linked to it into a system of government enabling their direction or regulation;
* the implementation of a functional economy, based on the generation, integration and valorization of products, services and assets that can be exploited within and outside Oniverse;
* the existence of a jurisdictional system for settling disputes arising from all these activities.

#### **Article 2.**

The Constitution and laws of Oniverse, as well as its institutional system, guarantee the organic and functional independence of the authorities involved in its government and regulation.

Oniverse's governance, as well as the enshrinement and guarantee of the rights and duties deriving from its institutional and normative system, are carried out in compliance with national and international standards that may apply to Oniverse's activities.

#### **Article 3**.

Members of Oniverse's deliberative assemblies are accountable to the Citizens and to the Oniverse Council.

#### **Article 4**.

Oniverse promotes the value of creative and narrative experiences, as well as valorizing and guaranteeing the ownership of all intellectual, artistic and aesthetic productions related to its environment.

#### **Article 5**.

Oniverse's system of standards and governance encourages reasoned physical and digital consumption, as well as the use of the most eco-responsible techniques possible for its own operations.

Oniverse's normative and governance systems guarantee the security of users, citizens and their data, respect for their privacy and the civility of exchanges.

They promote political and social pluralism within Oniverse.

#### **Article 6**.

The techniques on which Oniverse relies favor the broadest possible persistence, synchronization, instantaneity and accessibility, without discrimination, other than that based on suffrage or merit, or on grounds relating to the best interests of Oniverse. The latter must be proportionate to and in line with the objective pursued, which must itself be explicit.

#### **Article 7**.

Techniques and technologies, including "disruptive" ones, are used to enhance the effectiveness and efficiency of Oniverse's decision-making processes. They are in no way intended to replace them. Any systematic and compulsory use of virtual, augmented or mixed reality is excluded.

The use of algorithms and cryptography, including "smart" contracts, consensus protocols and distributed registries, is at the service of democracy and the continuity of Oniverse's system of government and justice. It promotes the disintermediation and transparency of Oniverse's economic, political and jurisdictional system, as well as the autonomy of its political community and its members. It meets the applicable transparency requirements of national and international standards.

## **Title II - Sovereignty**

#### **Article 8.**

Accession to Oniverse citizenship is based on material participation or merit.

It’s community of citizens is Oniverse's main political body. It is made up of all the Citizens of Oniverse, to whom the collective sovereignty of Oniverse belongs.

This sovereignty is exercised either directly, through processes of ratification or citizens' initiative, or through the intermediary of representatives.

Oniverse representatives are members of the Oniverse Assembly, Senate and Council.

#### **Article 9.**

Oniverse has a vocation :

* to integrate autonomous worlds other than Foundation World and its zones of influence;
* enter into association agreements with operators to share its technical support and its institutional and standards structure, with a share that varies according to the terms of the agreement.

Oniverse Citizenship is available only to users of worlds integrated within Oniverse.

#### **Article 10.**

Suffrage and merit are the two preferred methods of appointment to the positions of Oniverse representative or administrator.

Citizens' votes are secured and anonymized through the use of cryptography, consensus protocols and distributed trust registers.

The votes of representatives sitting in the Assembly and Senate are similarly secured, but are made public.

#### **Article 11**.

Political Parties are non-profit associations of Citizens whose function is to convey, share and confront competing visions of Oniverse's collective interest.

They contribute to the shaping and pluralistic expression of the political opinions of Oniverse's Citizens.

Political Parties may be represented in Parliament by political Groups.

#### **Article 12**.

The minimum number of Citizens required to form a political Party is set by the Oniverse Council.

The creation of a political Party by a group of Citizens meeting this membership requirement is subject to prior authorization by the Oniverse High Administration. Citizens wishing to set up a political Party must specify the Party's official name, its internal operating procedures, and present a political declaration setting out in sufficient detail the major orientations of the Party's political project, as well as the specific conditions required to join or be excluded from the Party.

Oniverse's High Administration assesses the compatibility of these elements with Oniverse's best interests and the proper functioning of its system of government.

Any substantial change in a Party's status requires a new authorization.

Oniverse's High Administration can dissolve a Party if it is detrimental to the best interests of Oniverse or to the regular functioning of its system of government.

#### **Article 13.**

Any Citizen may become a member of a Party, provided that they meet the specific conditions of membership, if any.

Any Citizen can leave a Party at any time.

#### **Article 14.**

A Party's internal operating procedures provide for the appointment of a Party president.

Failing this, the Party president is the Citizen who filed the application for prior authorization.

In association with the presidents of the political Groups, the Party presidents may be called upon to assess the likelihood of success of a proposed law, tabled and examined under the procedure laid down in articles 27 to 31, as well as under the procedure laid down in article 34.

## **Title III - Relations between Central City and the areas of influence**

#### **Article 15.**

Oniverse's representatives and administration are based at Foundation World in Central City.

#### **Article 16.**

While respecting the competence of Oniverse's representatives and administration, each of the species embodying the diversity of the territory and populations over which Oniverse's sovereignty extends enjoys regional autonomy within its area of influence, enabling it to administer its local affairs according to its own customs.

Oniverse's representatives and Citizens will be asked to decide on the respective allocation of areas of influence.

#### **Article 17.**

Local, administrative, clan, traditional or cultural affiliations deriving from affiliation with areas of influence may not lead to any infringement of the rights and duties deriving from Oniverse citizenship.

## **Title IV - Parliament**

#### **Article 18.**

Through its powers of proposal and legislative deliberation, or through the opinions it issues, the Oniverse Parliament helps shape the will of the Oniverse political community.

The operation of the Oniverse Parliament is governed by regulations adopted by the Oniverse Council, after consultation with the Senate.

#### **Article 19.**

The Senate is the upper House of the Oniverse Parliament. Its members are the Senators. Their number is determined by the Oniverse Council.

"Senate" is also the traditional name of the building in which the members of the Oniverse Parliament, Senators and Deputies, sit.

#### **Article 20.**

Senators are elected at regular intervals by the citizens of Oniverse.

The Council of Oniverse, at the suggestion of the Senate or on its own initiative, may appoint some of Oniverse's most active and dedicated citizens as Senators.

After each senatorial election, the Senators elect the president of the Senate from among their number, in accordance with the procedures determined by the Oniverse Council.

#### **Article 21.**

The Assembly is the lower House of the Oniverse Parliament. Its members are the Deputies. Their number is set by the Oniverse Council.

#### **Article 22.**

Deputies are elected at regular intervals by the citizens of Oniverse.

The Oniverse Council may appoint some of Oniverse's most active and dedicated citizens as Deputies.

#### **Article 23.**

The terms of accountability of members of the Assembly and Senate to the Citizens and Council of Oniverse will eventually be submitted to the representatives and Citizens of Oniverse.

#### **Article 24**.

Deputies and Senators come together according to their political and partisan affinities within political Groups specific to their respective Houses.

Political parties may be represented by political Groups in one or both Houses of Parliament. Senators and Deputies who are members of a Party belong, where appropriate, to the corresponding political Group.

#### **Article 25**.

A political Group is created on the initiative of a member of Parliament, with the support of a minimum number of members.

This is subject to a prior declaration to the president of the House to which the Group's founder belongs, and to the Oniverse's High Administration. This declaration includes, in addition to the official name of the Group and its internal operating procedures, a political declaration setting out in detail the main thrust of the Group's political project. Where applicable, it must also specify the specific conditions required to join or leave the Group. These documents are submitted to the Oniverse Council.

Any substantial change in a Group's declaration is subject to a new declaration.

The Oniverse Council may prohibit the formation of a political Group or dissolve a political Group if its elements or activities are incompatible with the best interests of Oniverse and the proper functioning of its system of government.

Any political Group whose membership falls below the minimum is automatically dissolved.

#### **Article 26.**

A political Group may decide to join a political Party of its choice. Several Groups may be attached to the same Party. A political Group president may not also be Party president.

#### **Article 27.**

The president of a political Group is appointed in accordance with the rules governing the Group's internal operation. Failing this, the Group president is the member of Parliament who made the declaration prior to the Group's formation.

The presidents of the political Groups in the Oniverse Parliament have the right to initiate legislation in accordance with article 27.

In association with the chairmen of the political Parties, the presidents of the political Groups may be called upon to assess the likelihood of success of a proposed law, tabled and examined under the procedure laid down in articles 27 to 31, as well as under the procedure laid down in article 34.

## **Title V - Legislative procedure**

#### **Article 28.**

Legislation is initiated by the presidents of the political Groups in both Houses of Parliament.

It takes the form of proposals drawn up according to procedures determined internally by the political Groups. These proposals, which are limited in number for each Group, are submitted to the Senate at regular intervals.

#### **Article 29**.

The content of bills must be explicit and unique, failing which they will be declared inadmissible by the president of the Senate.

The likelihood of bills being passed by the Senate may be subject to assessment by the presidents of the parliamentary political Groups and the presidents of the Oniverse political Parties. The results of this assessment may determine whether or not these proposals can be examined in the Senate.

#### **Article 30**.

Senators adopt or reject bills submitted to them by relative majority.

In the event of a tie, the president of the Senate has the casting vote.

#### **Article 31**.

At regular intervals, the Citizens of Oniverse are called upon to ratify or reject by relative majority the laws passed by the Senate.

The likelihood of ratification of laws passed by the Senate may be subject to assessment by the presidents of the parliamentary political Groups and the presidents of the Oniverse political Parties. The results of this assessment may condition the possibility of submitting these laws for ratification.

#### **Article 32**.

The Oniverse Council regularly promulgates laws ratified by the Citizens of Oniverse.

The Council is sovereign in its assessment of the conformity of ratified laws with the higher interests of Oniverse, and their compatibility with the regular functioning of its system of government. It then decides whether to promulgate them or to abandon them, in whole or in part.

Promulgated laws come into force on publication.

## **Title VI - The Council**

#### **Article 33.**

The Oniverse Council is the guarantor of Oniverse's best interests and the proper functioning of its system of government.

#### **Article 34.**

The Oniverse Board is initially made up of members of the Oniverse developer Studio. Its operation is governed by a set of Rules of Procedure.

Oniverse's most active and dedicated Citizens will eventually be encouraged to stand for designation to a set share of reserved seats on the Oniverse Council, according to terms to be submitted to Oniverse's representatives and Citizens.

#### **Article 35.**

The Council may decide, on its own initiative, to promulgate a law, without restriction as to purpose or content.

Before being promulgated, these texts may be submitted to the Senate for an advisory opinion, which is adopted by a relative majority. Before being submitted to the Senate for its opinion, they may be submitted to the presidents of the political Groups and the presidents of the Oniverse political Parties for assessment of their likelihood of success.

Based on pre-established criteria, the Council is responsible for granting Oniverse citizenship. Exceptional access to this citizenship may be granted for any outstanding contribution to the collective interest of Oniverse.

The Council is solely responsible for setting common contributions to Oniverse's public operating expenses.

#### **Article 36.**

The Council is responsible for the administration of Oniverse, while respecting the Constitution, the law and the independence of Oniverse's jurisdictional system.

## **Title VII - Administration**

#### **Article 37.**

Users and Citizens are encouraged to take on public responsibilities within the Oniverse administration.

Users and Citizens are eligible for such positions without distinction other than that of merit, and according to terms and conditions determined by the Oniverse Council. The Council also determines the statutes of the Oniverse administration. These terms and conditions may eventually be submitted to Oniverse representatives and Citizens.

Central City's administration is responsible for enforcing Oniverse's laws and adopting the necessary regulatory measures.

#### **Article 38.**

Oniverse's High Administration is made up of the leading Citizens of Central City's administrative departments, as well as the local governing and management bodies of Central City's various areas of influence.

## **Title VIII - Justice**

#### **Article 39**.

Oniverse Justice is based on a rapid, affordable and fair dispute resolution system, insofar as the security and performance that characterize its mode of operation encourage the productive participation of Citizens and make the system structurally performative.

#### **Article 40**.

Any disputes that may arise between Oniverse's various stakeholders, and any reprehensible acts qualified as such by its administrative staff and by virtue of its operating standards, are subject to its jurisdictional system.

They are awarded either ex officio, on appeal by the parties concerned, or on a contractual basis.

On a conventional basis, disputes which may fall within the jurisdiction of an arbitration body, according to the national or international standards applicable to each case, may be submitted to the Oniverse jurisdictional system.

#### **Article 41.**

Oniverse's legal system is centralized and non-hierarchical. A single court has jurisdiction over each dispute, depending on its field of intervention.

#### **Article 42**.

The Supreme Court of Oniverse is called upon to hear Oniverse's most important and sensitive disputes. To this end, it has jurisdiction in a number of areas determined by the Oniverse Council. It also has general residual jurisdiction.

#### **Article 43.**

Ordinary Courts make up a diverse category, within which they all have specialized jurisdiction.

The Specialized Courts are called upon to hear disputes falling within their respective jurisdictions.

Regional Courts are called upon to hear disputes relating to decisions adopted by local administration systems in Foundation World's regional zones of influence, and in worlds integrated with Oniverse.

#### **Article 44.**

For each case, Oniverse's judging panels are made up of jurors drawn by lot, selected and remunerated according to a weighting system and from dedicated pools. These systems and pools are based on the possession of skills assets, the acquisition of which will be favored by the respective content of the jurors' participation in the decisions rendered.

#### **Article 45.**

Each judging panel is presided over by the juror with the most assets.

#### **Article 46**.

After an adversarial procedure, the panels rule on the disputes submitted to them by a relative majority vote, with the president of each panel casting the deciding vote in the event of a tie.

#### **Article 47**.

The operation of the Oniverse jurisdictional system is detailed in a set of Rules of Procedure drawn up by the Oniverse Council.

## **Title IX- Revision**

#### **Article 48.**

The Oniverse Constitution is a living instrument, designed to accompany and structure the democratic and normative development of Oniverse.

#### **Article 49.**

The Council alone decides on the revision of the Constitution of Oniverse and conducts this revision. A constitutional revision procedure will eventually be submitted by the Council to the representatives and Citizens of Oniverse. For its elaboration, the Council will gather and consider the opinions of Oniverse's political community. It will reserve an essential part for the initiative of the representatives and the approval of the Citizens.
